When I was a 19-year old college student, I made a mistake that did not resurface until a year and a half later. Luckily, Andy Shubin was there to assist me. During the final months of my senior year, where I was top of my class, had a job offer, and was in great health, my life had become dark with the clouds of mystery and uncertain fate from my legal situation—I had tangible discomfort. Andy, along with my parents, was the only shining stars in a sky filled with turmoil. Andy steered us towards the most relevant issues in the case, working both with our ideas and adding his own careful legal interpretation of the situation. He steered us away from issues that were personally important to us, but which could have been counter-productive to our case, or at best dead-ends. He was unfailingly discrete, pleasant and professional while dealing with a very serious and unpleasant matter. He was polite and respectful to everyone involved, even when we didn’t want to be, but he was quick to defend us when needed. The first lawyer we spoke with didn’t know the law around our case and quickly advised that it wasn’t really too important – which was dead wrong. Andy immediately recognized the seriousness of the matter, did extensive research to build a case, guided us through the slow, frustrating legal system, helped us to avoid stress and harm during the process as much as was possible, and ultimately helped us to win. We had never been involved in litigation before. We learned that there are good and bad lawyers out there. Andy is a very good one. Amazing attorney!! Andrew Shubin was appointed to me through the Federal Courts when I was 19. I didn’t have the income to pay for an attorney out of pocket and I was facing two very serious criminal counts involving conspiracy. I immediately was concerned before I even met Andrew thinking that I wasn’t going to be a priority because I wasn’t paying him . Most cases you hear of involving Public Defenders don’t turn out too well for the defendents. I can assure you that was not the case with Andrew Shubin.
I was in a case with over 30 co-defendents facing similar or exact charges and I received the lowest prison sentence out of everyone that was involved in the case. Andrew got one of the counts completely dropped and the other significantly reduced. I was blessed the day I met him and I thank GOD that I was so fortunate to have such a caring and hard working attorney. Words can’t even do justice to how wonderful of a person he is, not just an attorney. Even after my sentencing date I still received a letter from Andrew wishing me luck and asking me to contact him in the future to let him know how I was doing. As you may remember it was not too long ago when David and I requested your assistance to help R. You were successful in getting R’s sentence reduced from a felony to a misdeameanor. Yesterday, R shared with his Dad and I that he made the deans’ list. R had 5 science courses and was able to pull off 4 A’s and 1 B. He continues to work part time . . . and is a very dedicated student majoring in biology with his eye on a Phd. in genetics. After working 30 years in my professional field, I never thought I would be sabotaged by an employer, but when I was unjustly terminated from a Director’s position, I was devastated. But I put it aside, wrote a rebuttal to my termination, and applied for Unemployment. I was granted Unemployment Compensation. However, much to my surprise, my Employer appealed the decision. Knowing they were a large corporation with a team of attorneys, I knew I could not enter the hearing without representation; that is when I contacted Andrew Shubin. Andy was compassionate and understanding of my story, but he helped me stick to the facts. He was brilliant and masterful during the hearing, resulting in a win for us. This was a blessing as I had a family to support. But Andy didn’t stop there, he continued to support me with yet another appeal from my Employer. Again the ruling was in our favor. As you prepare for your child to come into the world, any expecting parent dreams for only one thing, “A Healthy Child.” In one small moment that realization had been crushed right in front of us. Our son had been born with a lifelong disability, cerebral palsy. I, for the most part, wasn’t sure how to feel about the situation. My emotions were in tatters. I felt frozen in time, empty and disconnected. As our son spent several months in the hospital, we turned to friends, family, and God for comfort and consolation.
We had been discussing the situation since his birth and finally decided that we were going to pursue legal action for our son. This decision did not come easy for us. Neither of us had taken legal action toward anyone before. We had mixed emotions about it, but as you take small steps forward in becoming a new parent your mindset changes. What we needed to do now was best for our child. Nothing else mattered.
Shortly after the hospital we had come in touch with Andrew Shubin, a well-known defense lawyer in the State College, PA area. Andy swiftly got the case moving forward. . . and assembled a priceless team to help us with our situation and sons’ future. Over the next two years or so we went back and forth until finally a settlement had been reached.
Around the time of the settlement closing our son was about two years old. Caring for our son was getting complex, and it was only going to get more difficult. At this time, all of the settlement was put into a fund that would pay out as considered necessary. It was a greatly timed blessing of relief that had seemed to come out of nowhere. … Roughly seven years have passed now since the settlement, and our son is almost 9 years old. DRIVING WHILE BLACKAltoona Police Officer charges African American Penn State student who was a passenger in a car driven by and African American driver. After a physical altercation, police charge student with Resisting Arrest and Disorderly Conduct. Charges dismissed after hearing.
I was a passenger driving through . . . Altoona PA . . . with another African American. We were asking for directions (and) . . . approached by an officer who asked us why we were in Altoona . . . and . . .told the driver his tinted windows were illegal. The officer asked again, “Why are you in Altoona” . . . Fifteen to twenty minutes later, several squad cars aligned behind the car we were in and the officer told me to get out of the car. . . Several officers began to scream simultaneously, which left me confused and in fear for my life. As I just tried to keep my hands up the officer reached for my belt and slammed me down to the ground, shouting “This aint State College Pa, we don’t play that out here.” This went on for several minutes—kicking and slamming my head against the tire and door of the vehicle and tire . . . the officers asked me repeatedly, “Where’s the drugs?”
I sought out Andrew Shubin for representation, and explained to him the dynamics and details of the case. Andrew Shubin recommended that we have a . . . hearing. Attorney Shubin (argued successfully) for a dismissal based on the fact that the (officer’s) suspicion was based on the fact that we were African Americans. The case was dismissed.
I learned a lot that night, and I hope this testimonial can shed some light on the fine line between being guilty of a crime, and having your civil rights violated—not even as a person of color, but simply as a human being.
